These Terms and Conditions (“Terms”) govern your access to and use of the Everything Sports mobile application, website, and related services (collectively, the “Service”) provided by Joseph S Apps, LLC (“Everything Sports,” “we,” “us,” or “our”). By downloading, accessing, or using the Service, you agree to these Terms.

If you do not agree to these Terms, do not use the Service.

1. Eligibility and Accounts

You must be at least 13 years old, or the minimum age required in your jurisdiction, to use the Service. If you create an account, you agree to provide accurate information and keep your login credentials secure. You are responsible for activity that occurs under your account.

2. Description of the Service

Everything Sports provides sports-related content and tools, which may include live scores, schedules, standings, news, player statistics, game details, alerts, video links, odds history, matchup tools, playoff picture data, team win/loss history, AI-powered sports question features, and related content.

Some content is provided by or derived from third-party data sources, publishers, platforms, and websites. Availability, accuracy, and timeliness may vary.

3. Free and Paid Access

Everything Sports currently offers:

• Free access to selected app features
• Pro access to premium features

Premium features may include Player Stats, matchup tools, favorites, watchlists, alerts, play-by-play, odds history, team-level filters, historical team win/loss archives, playoff tools, AI-powered sports questions, and other paid tools that we may add or modify over time.

4. Subscription Terms

If you purchase a Pro subscription through Apple In-App Purchase:

• The subscription is offered at $9.99 per month unless otherwise shown in the App Store for your region
• A 14-day free trial may be offered to eligible new subscribers
• After the trial ends, your subscription automatically renews each month unless canceled
• Payment will be charged to your Apple ID account at confirmation of purchase or, for eligible trials, at the end of the free trial period
• Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period
• You can manage or cancel your subscription in your Apple account subscription settings
• Refunds, billing issues, and payment processing for App Store purchases are handled by Apple, subject to Apple’s policies

We may change subscription offerings, pricing, or feature availability in the future as permitted by applicable law and platform rules.

5. AI Features

The Service may include AI-powered tools, including Any Sports Question.

By using AI features, you understand and agree that:

• responses are generated automatically and may be inaccurate, incomplete, delayed, or outdated
• AI responses are for general informational purposes only
• you should independently verify time-sensitive information, including scores, standings, odds, injuries, and breaking news
• you will not rely solely on AI responses for gambling, legal, medical, financial, or other high-stakes decisions
• we may suspend, limit, or modify AI features at any time
• your prompts may be processed by backend and third-party service providers to generate responses

6. Acceptable Use

You agree not to:

• use the Service for unlawful, fraudulent, or abusive purposes
• interfere with or disrupt the Service or its servers
• attempt to gain unauthorized access to any part of the Service
• copy, scrape, republish, or redistribute app content except as permitted by law or by our written permission
• reverse engineer, decompile, or attempt to extract source code from the Service except where prohibited by law
• use bots, automation, or other methods to overload the Service
• submit unlawful, infringing, abusive, or malicious content through AI or other interactive features
• attempt to bypass subscription restrictions, feature limits, or access controls

7. Third-Party Content and Links

The Service may display, embed, summarize, or link to third-party content, including sports data, news articles, videos, odds, and external websites. We do not own all third-party content made available through the Service.

Third-party names, logos, trademarks, and content remain the property of their respective owners. Your use of third-party websites or services is subject to those third parties’ terms and policies.

8. No Gambling, Financial, or Professional Advice

Odds, lines, betting-related information, AI-generated answers, and other statistical information are provided for informational and entertainment purposes only. Nothing in the Service constitutes gambling advice, financial advice, legal advice, medical advice, or professional advice.

The Service does not accept wagers, place bets, or operate as a sportsbook.

You are solely responsible for complying with all laws applicable to your location and conduct.

9. Accuracy and Availability Disclaimer

We try to keep the Service useful and up to date, but we do not guarantee that scores, schedules, odds, standings, statistics, injuries, previews, alerts, AI responses, or other content will always be accurate, complete, current, or available.

Features may be changed, delayed, suspended, or removed at any time.

10. Intellectual Property

Except for third-party materials, the Service, including its design, layout, branding, text, graphics, software, and original content, is owned by or licensed to Everything Sports and protected by applicable intellectual property laws.

These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.

11. Termination and Suspension

We may suspend or terminate your access to the Service if we believe you violated these Terms, misused the Service, or created risk or harm to us, our users, or third parties.

You may stop using the Service at any time. Deleting the app does not automatically cancel an active subscription. Subscription cancellation must be handled through your Apple subscription settings.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVERYTHING SPORTS AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability for claims relating to the Service will not exceed the amount you paid to us for the Service in the twelve months before the event giving rise to the claim, or one hundred U.S. dollars (US $100), whichever is greater.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the Effective Date above. Your continued use of the Service after updated Terms become effective means you accept the revised Terms.

15. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of laws rules, except where consumer protection laws require otherwise.
