IMPORTANT — PLEASE READ: By downloading, accessing, or using the In Search Of… mobile application and related services (collectively, the “Services”), you agree to these Terms & Conditions (“Terms”). If you do not agree, do not use the Services.

1) Eligibility (18+ Only)

You must be at least 18 years old to use the Services. By creating an account or using the Services, you represent and warrant that you are 18+.

2) What the Services Are (Platform Only)

In Search Of… is a platform that helps users discover local listings, post listings, browse users, and communicate through in-app messaging.

We are not a party to any agreement, transaction, or interaction between users. We do not guarantee the quality, safety, legality, or accuracy of listings, profiles, messages, or user conduct.

3) Accounts & Sign-In

You may create an account using Apple Sign-In, Google Sign-In, or email/password. You agree to:

Provide accurate information where required
Keep your account secure and not share credentials
Take responsibility for activity that occurs under your account

We may suspend or terminate accounts that violate these Terms or create risk to others.

4) Listings, Profiles, Messages, and User Content

The Services allow users to create and share content, including listings, profile details/photos, messages, and other materials (“User Content”).

You are solely responsible for your User Content and agree that it must be:

Lawful and non-deceptive
Accurate to the best of your knowledge
Not infringing on others’ rights (copyright, trademark, privacy, etc.)

License You Grant

You retain ownership of your User Content. You grant the Company a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute your User Content as necessary to operate and improve the Services (for example: showing your listing in nearby results).

5) Zero-Tolerance Policy (Objectionable Content & Conduct)

We maintain a zero-tolerance policy for illegal, harmful, or objectionable content or behavior. This includes (without limitation):

Harassment, threats, bullying, stalking, intimidation
Hate speech, discrimination, or targeted abuse
Sexual exploitation, pornography, or any content involving minors
Violence, encouragement of violence, or graphic harm content
Scams, fraud, impersonation, phishing, or deceptive practices
Sharing another person’s private information without consent
Spam, mass solicitation, or malicious links
Illegal goods/services or facilitation of illegal activity
Intellectual property infringement

We may remove content and/or restrict or terminate accounts that violate this policy.

6) Reporting, Blocking, and Moderation

The Services include block and report tools.

Users can report content or behavior that violates these Terms.
We may review reports and take action at our discretion (warnings, removals, suspensions, bans).
We do not guarantee that all objectionable content will be removed immediately or that all users will comply with these Terms.

7) Safety and Offline Interactions

ISO may lead to in-person meetings or transactions. You agree you are responsible for your safety and decisions, including:

Meeting in public places
Using safe payment methods
Inspecting items/services before payment
Trusting your instincts and ending interactions that feel unsafe

You use the Services at your own risk. The Company is not responsible for disputes, injuries, theft, loss, damages, or outcomes arising from user interactions.

8) Prohibited Technical Use

You may not:

Reverse engineer, decompile, or attempt to extract source code
Scrape, harvest, or bulk-collect data
Bypass security, access controls, or moderation systems
Use bots/automation to post or message
Upload malware or disrupt the Services

9) Third-Party Services

The Services may rely on third parties (e.g., Apple/Google sign-in, cloud services, push notifications). Your use of those services may be governed by their own terms and policies. We are not responsible for third-party services.

10) Intellectual Property

The Services (software, UI, branding, and related assets) are owned by Joseph S Apps, LLC or its licensors and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any portion of the Services without written permission.

11) Termination

You may stop using the Services at any time. We may suspend or terminate access if we believe you violated these Terms, created safety risks, or abused the platform. Certain data may remain as described in the Privacy Policy.

12) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOSEPH S APPS, LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSSES ARISING FROM USER CONTENT OR USER INTERACTIONS.

OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

14) Indemnification

You agree to indemnify and hold harmless Joseph S Apps, LLC from claims, losses, liabilities, and expenses (including attorneys’ fees) arising from your use of the Services, your User Content, your interactions, or your violation of these Terms.

15) Governing Law

These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict-of-law principles.

16) Changes to These Terms

We may update these Terms from time to time. We will post updates on our website and/or in the app with an updated effective date. Continued use after changes means you accept the updated Terms.
