1. Agreement to These Terms

These Terms and Conditions (“Terms”) are a legal agreement between you and Joseph S Apps, LLC (“Rise Up,” “we,” “us,” or “our”) governing your access to and use of Rise Up Social and all related websites, apps, features, pages, content, and services that link to these Terms (collectively, the “Service”).

The Service includes the Rise Up social network, profiles, posts, clips, comments, galleries, groups, My Circle, follow and friend tools, direct messages, In Search Of marketplace listings and messages, Black Business Finder, business pages, V-check verification, push notifications, Hopeless Ro dating, Ro Signal, Ro Map, First Five, Rose Room, safety tools, and future features connected to Rise Up.

By creating an account, accessing, browsing, posting, messaging, listing, using Hopeless Ro, or otherwise using the Service, you agree to these Terms, our Privacy Policy, and our Child and Safety Standards. If you do not agree, do not use the Service.

2. Eligibility

• You must be at least 13 years old, or the minimum age required by law in your location, to use the general Rise Up Service.
• You must be at least 18 years old to use Hopeless Ro, Ro Signal, Ro Map dating discovery, First Five, Rose Room, dating photos, dating profiles, or any dating-related feature.
• You may not use the Service if you are prohibited from doing so by law, if your account has been suspended or banned, or if you are required to register as a sex offender unless applicable law prohibits us from restricting access on that basis.
• You are responsible for ensuring that your use of the Service is legal in your location.

3. Account Registration and Accuracy

You agree to provide accurate, current, and complete account information and to keep it updated. You may not impersonate another person, misrepresent your identity, create an account for someone else without authorization, use another person’s email or phone number without permission, use false age information, or create accounts to evade moderation, blocks, bans, or safety restrictions.

You are responsible for maintaining the confidentiality of your account, login credentials, device access, and activity. Notify us immediately if you believe your account has been compromised.

4. V-Check Verification

Rise Up may offer a V-check badge after email, phone, or other verification steps. A V-check badge means only that an account completed the verification steps made available by the Service. It does not guarantee a user’s legal identity, age beyond app requirements, criminal history, relationship status, employment, business ownership, intentions, safety, financial condition, health status, trustworthiness, or truthfulness. You are responsible for your own judgment when interacting with others.

5. User Content

“User Content” means any content you create, upload, post, list, send, share, save, submit, or make available through the Service, including text, photos, videos, clips, captions, comments, replies, profile information, business information, group content, marketplace listings, messages, dating profile answers, First Five messages, Rose Room messages, and reports.

You retain ownership of your User Content, but you grant Rise Up a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, copy, display, perform, reproduce, modify for formatting, translate, distribute, transmit, publish, and use your User Content as needed to operate, promote, protect, and improve the Service. This license includes the right to show your content to other users according to the features you use and your settings.

You represent and warrant that you own or have the rights needed to share your User Content and that your User Content does not violate law, these Terms, our safety standards, or anyone else’s rights.

6. Public Content and User Responsibility

You understand that public profiles, posts, clips, comments, group activity, business pages, listings, and other public content may be visible to other users. Other users may screenshot, copy, share, save, report, or misuse content. Rise Up is not responsible for user misuse, misrepresentation, screenshots, copying, off-platform sharing, unauthorized reposting, or actions taken by other users.

If you do not want content to be seen, copied, reported, preserved, or shared, do not post or send it through the Service.

7. Prohibited Conduct

You may not use the Service to:

• Violate any law, regulation, court order, platform rule, or third-party right.
• Impersonate, misrepresent, deceive, catfish, use false age information, falsely claim affiliation, or misstate business ownership, credentials, services, products, opportunities, relationship status, or intentions.
• Harass, threaten, abuse, bully, stalk, intimidate, dox, exploit, shame, or target another person.
• Post, send, request, store, or distribute CSAM, child sexual exploitation, grooming, sexual solicitation of minors, trafficking, sextortion, or sexual content involving minors.
• Post or send non-consensual intimate content, revenge content, hidden-camera content, deepfake sexual content, or threats to share private content.
• Promote violence, self-harm, hate, terrorism, exploitation, fraud, scams, illegal goods, or unsafe activity.
• Upload malware, spam, phishing content, fake giveaways, fake jobs, fake listings, fraudulent business pages, or deceptive links.
• Interfere with the Service, scrape data, reverse engineer, automate activity, bypass security, evade blocks or bans, or overload the Service.
• Use another person’s photos, name, likeness, business information, identity, or copyrighted material without permission.
• Use Rise Up to collect, expose, sell, or misuse personal information about others.

8. Child Safety and Adult Content

Rise Up has zero tolerance for child sexual abuse and exploitation. You must follow our Child and Safety Standards at all times. Hopeless Ro is 18+ only. Users may not use any part of the Service to sexualize, exploit, groom, solicit, recruit, traffic, endanger, or target minors. We may report suspected CSAM or child exploitation to the National Center for Missing and Exploited Children, law enforcement, child safety organizations, or other proper authorities when required or appropriate.

9. Rise Up Social Features

Rise Up may allow users to create profiles, post content, upload clips, comment, like, repost, follow, request friends, join My Circle, view suggestions, and participate in community spaces. You are responsible for your interactions and content. Rise Up does not guarantee that content is accurate, safe, lawful, current, or appropriate.

10. Groups

Groups allow users to create, join, view, post in, and participate in public or private topic spaces. Group owners and admins are responsible for operating groups lawfully and safely. We may remove groups, change visibility, remove content, restrict membership, reassign admin control, or close groups when needed for safety, legal compliance, inactivity, or platform integrity.

Private groups are intended to limit visibility, but they are not a guarantee of secrecy. Members may screenshot, copy, report, or disclose content. We may access, preserve, or review group content as needed for safety, support, enforcement, legal compliance, or service operations.

11. My Circle, Contacts, Follows, and Friends

My Circle may include friends, followers, following, requests, contact-based suggestions, and other connection tools. Suggestions are not endorsements and do not guarantee that a suggested person is safe, known to you, available, interested, or who they claim to be. If you permit contact access, you are responsible for having any rights required to allow the app to process contacts from your device.

12. Direct Messages

Rise Up may support direct messaging in different contexts, including Rise Up, Hopeless Ro, and In Search Of. Messages may also appear in a unified Rise Up DM inbox with labels. A DM labeled “Hopeless Ro” or “In Search Of” may route back to that specific feature’s conversation experience.

Messages are intended for respectful, lawful communication. They are not guaranteed to be end-to-end encrypted. We may access, preserve, or review messages when reported, when needed for safety or support, when required by law, or when necessary to operate or protect the Service. Recipients may screenshot, copy, save, report, or share messages.

13. In Search Of Marketplace

In Search Of allows users to post, browse, save, and message about listings, including items, needs, services, buying requests, selling posts, and community opportunities. Rise Up is not a seller, buyer, broker, employer, payment processor, shipping provider, escrow service, background-check provider, or party to transactions between users.

Users are solely responsible for listings, descriptions, pricing, availability, legality, taxes, licensing, permits, delivery, payment, refunds, disputes, safety, and compliance with applicable laws. We do not guarantee listings, buyers, sellers, services, jobs, opportunities, prices, quality, ownership, safety, legality, or outcomes.

Prohibited marketplace activity includes illegal goods or services, stolen goods, counterfeit goods, weapons, explosives, regulated drugs, controlled substances, prescription sales, trafficking, sexual services, adult exploitation, scams, deceptive job offers, pyramid schemes, and anything else prohibited by law or our policies.

14. Black Business Finder and Business Pages

Black Business Finder and business pages help users discover businesses and services. Business listings may be created, claimed, imported, edited, or submitted by users or other sources. Rise Up does not guarantee that a business is active, licensed, insured, Black-owned, available, safe, accurate, verified, or endorsed by us unless we expressly say so in writing.

Business owners and page admins are responsible for truthful information, lawful advertising, customer service, products, services, prices, appointments, taxes, licenses, permits, and compliance with consumer protection and business laws. Users are responsible for their own decisions when contacting, hiring, purchasing from, or visiting a business.

15. Hopeless Ro Dating

Hopeless Ro is an intentional dating experience inside Rise Up for adults 18 and older. Hopeless Ro may include separate dating photos, dating profile answers, Ro Signal, Ro Map, People with Substance, saved roses, First Five requests, First Five messages, Rose Room continuation, Rose Room messages, date readiness, block/report tools, and other safety features.

Hopeless Ro is not a matchmaking guarantee, background-check service, emergency service, identity-verification service, counseling service, or safety guarantee. We do not guarantee compatibility, intentions, truthfulness, availability, identity, age beyond app requirements, relationship status, criminal history, health status, financial status, or the outcome of any interaction.

You are solely responsible for your dating decisions, communications, meetings, transportation, boundaries, and safety. Meet in public, tell someone where you are going, use your own transportation, do not send money, and report suspicious or unsafe behavior.

16. Ro Signal, Ro Map, and Location

Ro Signal and Ro Map are designed to help adults discover nearby dating availability while protecting exact location. The app is intended to show approximate discovery areas, distance filters, or broad zones rather than exact device locations. You may not use Ro Signal, Ro Map, or any location feature to stalk, locate, follow, harass, expose, or endanger another person.

Distance, map, location, and availability information may be approximate, delayed, inaccurate, unavailable, or affected by device settings, permissions, network conditions, maps providers, or app errors. Do not rely on the Service for emergency location, navigation, or safety-critical decisions.

17. The First Five and The Rose Room

The First Five is designed to encourage intentional conversation before unlimited dating chat. Users may request, accept, decline, close, or block First Five interactions according to available features. The Rose Room opens only through the app’s continuation process and may require both users to choose to continue.

Closing a First Five or Rose Room may end or restrict messaging. The app may allow limited second-chance logic, but availability may depend on current settings, safety restrictions, account status, and platform rules. Rise Up is not responsible for emotional harm, disappointment, rejection, misrepresentation, or user conduct during dating interactions.

18. Safety Tools, Reports, and Enforcement

We may provide blocking, reporting, flagging, hiding, message controls, safety notices, moderation tools, and account restrictions. We may remove content, restrict features, disable accounts, preserve information, or take other action at our discretion if we believe a user violated these Terms, created risk, misused the Service, or harmed another person.

We are not required to monitor all content or interactions before they appear. We do not guarantee that every harmful user, message, listing, group, business, or post will be detected or removed. Users are responsible for reporting concerns and using available safety controls.

19. No User Misrepresentation Liability

Rise Up is not responsible for and does not guarantee the accuracy, truthfulness, legality, safety, or reliability of user profiles, posts, messages, dating profiles, photos, business pages, marketplace listings, group claims, V-check badges, user statements, offers, services, identity claims, age claims, location claims, relationship claims, business claims, or any other user-generated content.

Users are solely responsible for their own representations and conduct. You agree that Rise Up and Joseph S Apps, LLC are not liable for misuse, impersonation, fraud, scams, catfishing, false statements, fake listings, unsafe meetings, business disputes, dating disputes, user conflicts, or off-platform activity by users, except where liability cannot be limited by law.

20. Intellectual Property

The Service, including the app name, logos, designs, interface, software, code, features, branding, text, graphics, and other materials provided by us, is owned by Joseph S Apps, LLC or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service except as allowed by law or with our written permission.

21. Copyright Complaints

If you believe content on the Service infringes your copyright, contact itsjosephsapps@gmail.com with your name, contact information, a description of the copyrighted work, the specific content you believe is infringing, a good-faith statement that the use is unauthorized, a statement that your notice is accurate and that you are the copyright owner or authorized to act for the owner, and your physical or electronic signature.

22. Third-Party Services

The Service may rely on third-party services, including app stores, authentication providers, cloud hosting, database services, file storage, maps, push notifications, analytics, crash reporting, phone verification, email providers, and linked websites. We are not responsible for third-party services, outages, errors, prices, terms, policies, content, security, or availability.

23. Payments, Purchases, Promotions, and Future Paid Features

If the Service offers paid features, subscriptions, promotions, advertisements, boosts, or in-app purchases, additional terms may apply. App store payment rules may also apply. Unless expressly stated, purchases are not guarantees of views, matches, business results, sales, leads, dates, followers, engagement, or outcomes.

24. Account Suspension, Termination, and Deletion

You may stop using the Service at any time. Account deletion tools may be available in the app. We may suspend, restrict, or terminate your account or access to any feature at any time if we believe you violated these Terms, violated law, created risk, harmed another user, abused the Service, infringed rights, or created legal exposure.

After account deletion, some information may remain in backups, logs, moderation records, reports, legal records, messages sent to others, group records, business records, or copies made by other users, as explained in the Privacy Policy.

25. Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent allowed by law, Rise Up disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, safety, security, reliability, and uninterrupted operation.

We do not guarantee that the Service will be error-free, secure, always available, free of harmful content, free of harmful users, or that content will be preserved. You use the Service at your own risk.

26. Limitation of Liability

To the maximum extent allowed by law, Joseph S Apps, LLC, Rise Up, and their owners, officers, employees, contractors, affiliates, partners, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages; loss of data, goodwill, reputation, business opportunities, revenue, or expected savings; personal interactions; marketplace disputes; business disputes; dating disputes; emotional distress; user misrepresentation; unauthorized content sharing; or off-platform conduct arising out of or related to the Service.

To the maximum extent allowed by law, our total liability for any claim relating to the Service or these Terms will not exceed the greater of the amount you paid directly to Rise Up for the Service in the six months before the claim or $100. Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.

27. Indemnification

You agree to defend, indemnify, and hold harmless Joseph S Apps, LLC, Rise Up, and their owners, officers, employees, contractors, affiliates, partners, and service providers from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Service, your User Content, your listings, your business activity, your dating activity, your communications, your violation of these Terms, your violation of law, your misrepresentation, your infringement of rights, or your interaction with another user.

28. Changes to the Service and Terms

We may modify, suspend, or discontinue all or part of the Service at any time. We may update these Terms from time to time. If changes are material, we may provide notice through the app, website, email, or another reasonable method. Continued use of the Service after updated Terms become effective means you accept the updated Terms.

29. Governing Law and Disputes

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules, except where applicable law requires otherwise. You agree to try to resolve disputes informally by contacting us before filing a claim. If a dispute cannot be resolved informally, the parties may pursue available legal remedies in a court with proper jurisdiction, unless applicable law requires a different process.
